Uber And Lyft Rider Sexual Assault Overview

Types of Abuse Accepted

• Rape / Sodomy
• Forced Manual Stimulation
• Forced Oral Copulation
• Non-consensual touching or kissing of a sexual body part
• Indecent exposure
• Masturbation

Accepted Criteria

• Female clients only
• Assaulted by an Uber or Lyft driver
• Passengers only
• Reported to at least one: rideshare company, police, therapist, medical professional, or family/friends (within 2 weeks)
• Or able to provide audio/video recordings
• Incident occurred in or around the vehicle
• Must provide proof of ride (receipt)
• Must fall within statute of limitations

Statute of Limitations

Required buffer before filing:

• Lyft: 90 days before SOL
• Uber: 45 days before SOL

General SOL by State:

• 1 Year: Kentucky, Louisiana, Tennessee
• 2 Years: AL, AK, AZ, CA, CO, CT, DE, FL, GA, HI, ID, IL, IN, IA, KS, MN, NV, NJ, NY (specific cases), OH, OK, OR, PA, TX, VA, WV
• 3 Years: AR, DC, MD, MA, MI, MS, MT, NH, NM, NY, NC, RI, SC, SD, VT, WA, WI
• 4 Years: NE, UT, WY
• 5 Years: MO
• 6 Years: ME, ND

State-Specific Extensions

• CA: 10 years for sexual assault cases
• NY: 20 years (post-2019 incidents), 3 years for others
• TX: 5 years (rape), 2 years (other conduct)
• CT: No SOL if criminal conviction, otherwise 2 years
